Welcome to a website operated by the Michigan Democratic Party (“MDP”). The website is referred to as the “MDP Site.” These Terms of Service apply and govern your use of this website, web-based applications, and any other tools and services operated by the MDP that link to these Terms of Service. The MDP Site is provided by MDP located at 606 Townsend St., Lansing, MI 48933.
These Terms of Service do not apply to websites that the MDP does not operate where the MDP entity has a presence, such as MDP pages on Facebook. This is not the Terms of Service for other MDP affiliates that may have a website.

By using the MDP Site, you agree to follow the rules set forth on these web pages. MDP reserves the right to change or modify any of the terms and conditions contained in these Terms of Service including our Privacy Policy Statement, so be sure to check these web pages occasionally. If we do make material changes, we will post a notice on our homepage that the Terms of Service have been modified and provide a link to the revised Terms of Service. By continuing to use our site after we post changes or modifications, you confirm that you accept those changes or modifications. Therefore, you should review these Terms of Service and applicable policies often to understand the terms and conditions that apply to your use of the MDP Site. If you don’t agree to the amended terms, you must stop using the MDP Site.
PRIVACY POLICY STATEMENT
Please review the MDP Privacy Policy Statement, which is part of these Terms of Service and describes how we handle personal information collected and used by the MDP. By using the MDP Site, you agree that we can collect, use, and share data from you as described in our Privacy Policy Statement. You assume all privacy, security, and other risks associated with providing any information, including personally identifiable information.
USING THE MDP SITE
a. Text Messages
MDP may send you recurring, automatic “Text Messages” about GOTV efforts, voter education, event invites and volunteer opportunities. Your consent to receive Text Messages is not a condition of using the Site, and you can cancel this service at any time. You will receive these Text Messages if you provide your consent by providing MDP with your phone number when signing up for [a volunteer opportunity]. Once your consent is provided, MDP will send informational Text Messages to you about all of the [volunteer opportunities] for which you are registered, until you opt out. See below for details on how to opt out.
In addition, if you provide further consent (for example, by checking the opt-in checkbox), you will receive Text Messages from MDP that MDP believes may be of interest to you.
You may receive Text Messages even if your phone number is on a corporate, state, or national Do Not Call list or registry. You understand that you are not required to provide such further consent to receive Text Messages as a condition of using the MDP Site, and you can opt-out of receiving Text Messages at any time by texting STOP.
Message and data rates may apply. Neither the MDP nor the participating carriers guarantee that Text Messages will be delivered.
MDP may discontinue its Text Messaging program at any time, without notice.
b. Short Code Text Messages
These Short Code Terms apply to automated Text Messages sent to you by MDP via a registered 10DLC number. Message and data rates may apply. Message frequency varies.
Your consent to receive Text Messages is not a condition of using the MDP Site, and you can cancel this service at any time. Just reply “STOP” to the automated Text Message sent to you. After you send the message “STOP” to us, we will send you a reply message to confirm that you have been unsubscribed. After this, you will no longer receive Text Messages from us.If you want to join again, just sign up as you did the first time.
Text Messages are sent by the MDP for the purpose of facilitating your attendance at a volunteer opportunity you signed up for. Examples include: reminding you about the volunteer opportunity or action you signed up for, reminding you to confirm your attendance before or after an event, and providing information about how to join a virtual event.
Participating carriers are: AT&T, Verizon Wireless, Sprint, T-Mobile, U.S. Cellular, Boost Mobile, MetroPCS, Virgin Mobile, Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central, IL (ECIT), Cellular One of Northeast Pennsylvania, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless). Note: Carriers are not liable for delayed or undelivered messages.

c. Email Notifications
In connection with your use of the MDP Site, we may send signup confirmations, GOTV efforts, voter education, event invites, volunteer opportunities, and other information via email. You will receive these email messages if you provide your consent by providing MDP with your email address when signing up for [a volunteer opportunity]. You may opt out of receiving future information via email by using the unsubscribe procedure specified on the email message.
LIMITED LICENSE TO USE THE MDP SITE
Unless otherwise indicated on the MDP Site, the MDP Site and all content and other materials on the MDP Site (including, without limitation, the MDP logo), and all designs, text, graphics, pictures, information, data, software running on our servers, sound files, other files, and the selection and arrangement thereof (collectively, the “Site Materials”) are the property of MDP.
You are granted a limited, non-exclusive, non-assignable, and non-sublicensable license to access and use the MDP Site for your informational, non-commercial and personal use only. Such license is for the sole purpose of enabling you to use and enjoy the benefit of the MDP Site, as provided by us, in accordance with these Terms of Service, and does not include: (a) any right for the resale or commercial use of the MDP Site or the Site Materials; (b) the distribution, public performance, or public display of any Site Materials; (c) any right to modify or otherwise make any derivative uses of the Site, the Site Materials, or any portion thereof; (d) use of any data mining, robots, or other data gathering or extraction methods; (e) downloading (other than the page caching) of any portion of the MDP Site, the Site Materials, or any information contained therein, except as expressly permitted on the MDP Site; or (f) any use of the MDP Site or the Site Materials other than for its intended purpose in accordance with these Terms of Service. Any use of the MDP Site or the Site Materials other than as specifically authorized in these Terms of Service is strictly prohibited and will terminate the license granted to you by MDP in these Terms of Service. Such unauthorized use may also violate applicable laws, including, without limitation, copyright and trademark laws and applicable communications regulations and statutes. This license is revocable at any time.
THIRD PARTY CONTENT AND EVENTS
The MDP may display, provide information regarding, or provide links to third-party volunteer opportunities, and may initiate or facilitate communications between you and third parties regarding such volunteer opportunities or events. However, the MDP does not endorse or control, and makes no representations or warranties of any kind regarding, any such third parties or any volunteer opportunities or events. Your participation in or use of any of these third-party opportunities or events, and your dealings or correspondence with any third parties in connection therewith (including communications facilitated via the MDP Site), are solely between you and such third party. The MDP is not responsible or liable for any third-party volunteer opportunity or event, for any loss or damage of any sort incurred as the result of any third-party volunteer opportunity or event, or your interaction with any third parties.
Your attendance at or use of any third-party volunteer opportunity or event is at your own discretion and risk.
MODIFYING AND TERMINATING THE MDP SITE
We are constantly changing and improving the MDP Site. We may add or remove functionalities or features, and we may suspend or stop all or part of the Site altogether, at any time, without any notice or liability.
You can stop using the MDP Site at any time, although we’ll be sorry to see you go. We may also stop providing the MDP Site to you, or add or create new limits to our Site, at any time.
Without limiting anything in any other section of these Terms of Service, the MDP reserves the right to investigate and/or terminate your access if you have violated these Terms of Service, misused the MDP Site, or behaved in a way that the MDP regards as inappropriate or unlawful, including actions or communications that occur on or off the MDP Site.
DISCLAIMERS AND LIMITATION OF LIABILITY
ALTHOUGH WE TAKE REASONABLE STEPS TO PREVENT THE INTRODUCTION OF VIRUSES, WORMS, “TROJAN HORSES,” OR OTHER DESTRUCTIVE MATERIALS TO THE MDP SITE, WE DO NOT GUARANTEE OR WARRANT THAT THE MDP SITE OR MATERIALS THAT MAY BE DOWNLOADED FROM THE MDP SITE ARE FREE FROM SUCH DESTRUCTIVE FEATURES. WE ARE NOT LIABLE FOR ANY DAMAGES OR HARM ATTRIBUTABLE TO SUCH FEATURES.
WE ARE NOT LIABLE FOR ANY CLAIM, LOSS, OR INJURY BASED ON ERRORS, OMISSIONS, INTERRUPTIONS. OR OTHER INACCURACIES IN THE MDP SITE, NOR FOR ANY CLAIM, LOSS. OR INJURY THAT RESULTS FROM YOUR USE OF THE MDP SITE OR YOUR BREACH OF ANY PROVISION OF THIS USER AGREEMENT.
TERMINATION
The MDP reserves the right to terminate the MDP Site and these Terms of Service at any time without notice for any reason, including, in the case of these Terms of Service, for your violation of any of the provisions. The Limitation of Liability and Governing Law Sections of these Terms of Service survive any such termination.
SEVERABILITY
If any provision of these Terms of Service shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Service and shall not affect the validity and enforceability of any remaining provisions.
GOVERNING LAW
The MDP Terms of Service is governed by the laws of the State of Michigan applicable to contracts made and performed there without regard to its conflicts of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts in the State of Michigan and County of Ingham County and waive any jurisdictional, venue, or inconvenient forum objections to such courts.
